ستاد حقوق بشر جمهوری اسلامی ایران با انتشار بیانیهای اعلام کرد: هدف قرار دادن عمدی شناورهای جستوجو و نجات دریایی، نقض فاحش قواعد بنیادین حقوق بینالملل بشردوستانه و اصول مربوط به حمایت از عملیات امدادی و نجات محسوب میشود.
ستاد حقوق بشر طی بیانیهای ضمن محکومیت حملههای عمدی آمریکا به شناورهای جستوجو و نجات دریایی، اعلام کرد: ماموریت انحصاری این شناورها، جستوجو، امدادرسانی و نجات جان افرادی است که در دریا گرفتار شدهاند و فعالیت آنان ارتباطی با عملیات نظامی یا مشارکت مستقیم در مخاصمات ندارد و هدف قرار دادن عمدی چنین شناورهایی، نقض جدی قواعد بنیادین حقوق بینالملل بشردوستانه و اصول مربوط به حمایت از عملیات امدادی و نجات محسوب میشود.
متن این بیانیه به شرح زیر است:
ستاد حقوق بشر جمهوری اسلامی ایران، حملات عمدی ایالات متحده آمریکا به شناورهای جستوجو و نجات دریایی جمهوری اسلامی ایران و تجهیزات بشردوستانه مرتبط با آن که را بهشدت محکوم کرده و آن را نقض فاحش و آشکار موازین و قواعد حقوق بشر، حقوق بینالملل بشردوستانه و اصول و مقررات حاکم بر حقوق بینالملل دریاها میداند؛ این جنایت، در تداوم سلسله اقدامات تجاوزکارانه و نقضهای فاحش تعهدات و قواعد حقوق بینالملل از سوی ایالات متحده آمریکا علیه حاکمیت، تمامیت ارضی و حقوق ملت جمهوری اسلامی ایران صورت گرفته است.
در نخستین ساعات روز پنجشنبه ۱۴۰۵/۵/۰۱ (۲۳ ژوئیه ۲۰۲۶)، نیروهای ایالات متحده آمریکا دو فروند شناور جستوجو و نجات دریایی جمهوری اسلامی ایران، با نامهای «ناجی-۱۵» و «ناجی-۱۶»، را که در آبهای سرزمینی جمهوری اسلامی ایران مشغول انجام ماموریتهای بشردوستانه بودند، هدف حمله قرار دادند؛ شناورهای جستوجو و نجات دریایی، به دلیل ماهیت کاملا بشردوستانه ماموریت خود، از جایگاه ویژهای در چارچوب حقوق بینالملل بشردوستانه برخوردارند.؛ ماموریت انحصاری این شناورها، جستوجو، امدادرسانی و نجات جان افرادی است که در دریا گرفتار شدهاند و فعالیت آنان ارتباطی با عملیات نظامی یا مشارکت مستقیم در مخاصمات ندارد؛ از اینرو، هدف قرار دادن عمدی چنین شناورهایی، نقض جدی قواعد بنیادین حقوق بینالملل بشردوستانه و اصول مربوط به حمایت از عملیات امدادی و نجات محسوب میشود.
ماده ۲۷ کنوانسیون دوم ژنو ۱۹۴۹ بر حمایت از قایقها و شناورهای کوچک مورد استفاده دولتها یا موسسات رسمی امداد و نجات ساحلی تاکید کرده و مقرر میدارد این شناورها باید مورد احترام قرار گرفته و از حمایت لازم برخوردار باشند؛ شناورهای «ناجی-۱۵» و «ناجی-۱۶» در زمان وقوع این حادثه صرفا در چارچوب ماموریتهای جستوجو و نجات دریایی فعالیت داشته و در هیچگونه عملیات نظامی یا مشارکت مستقیم در مخاصمات دخالت نداشتهاند؛ بنابراین، هدف قرار دادن عمدی این شناورها، نقضی جدی حقوق بینالملل بشردوستانه و جنایت جنگی آشکار محسوب میشود.
پرواضح است که این اقدام جنایتکارانه آمریکا نهتنها جان کارکنان و نیروهای امداد و نجات دریایی را بهطور مستقیم در معرض خطر قرار داده است، بلکه امنیت تمامی افرادی را که در دریا نیازمند امدادرسانی و نجات هستند، صرفنظر از تابعیت، ملیت یا هویت آنان، نیز تهدید میکند؛ حمله به تجهیزات و امکانات اختصاصیافته به عملیات جستوجو و نجات، امنیت و اعتماد لازم برای انجام ماموریتهای بشردوستانه دریایی را تضعیف کرده و میتواند پیامدهایی فراتر از یک حادثه مشخص برای ایمنی دریانوردان و افراد گرفتار در دریا به همراه داشته باشد.
با این حال این حادثه را نمیتوان صرفا یک رویداد منفرد تلقی کرد؛ از زمان آغاز تجاوز نظامی ایالات متحده آمریکا و رژیم صهیونیستی علیه جمهوری اسلامی ایران، موارد متعددی از حمله به شناورهای جستوجو و نجات و آمبولانسهای دریایی جمهوری اسلامی ایران که در ماموریتهای بشردوستانه و امدادی فعالیت داشتهاند، صورت گرفته است؛ تداوم چنین جنایاتی، بیانگر الگویی نگرانکننده از تعرض به تجهیزات و امکانات بشردوستانهای است که براساس قواعد حقوق بینالملل از حمایت برخوردارند؛ بی تردید حمایت از عملیات امدادی و بشردوستانه، از الزامات بنیادین حقوق بینالملل بشردوستانه محسوب میشود و هیچ طرفی نمیتواند با نادیده گرفتن این اصول، جان امدادگران و افراد غیرنظامی نیازمند کمک را در معرض خطر قرار دهد؛ هدف قرار دادن تجهیزات بشردوستانه و امدادی، علاوه بر آثار و پیامدهای جدی در حوزه حقوق بینالملل بشردوستانه، مسئولیت بینالمللی دولت عامل جنایت و مسئولیت کیفری فردی مرتکبان را در پی خواهد داشت.
با این حال آثار و پیامدهای این حملات غیرانسانی صرفا به نقض قواعد حقوق بینالملل بشردوستانه و مقررات حاکم بر ایمنی و امنیت فعالیتهای دریایی محدود نمیشود، بلکه از منظر حقوق بشر نیز واجد آثار و پیامدهای جدی است؛ هدف قرار دادن تجهیزات و شناورهایی که ماموریت انحصاری آنان جستوجو، امدادرسانی و نجات جان انسانها در دریا است، بهطور مستقیم جان و امنیت نیروهای امداد و نجات را در معرض خطر قرار داده و همزمان، امکان دسترسی تمامی افرادی را که در شرایط اضطراری در دریا نیازمند خدمات امدادی و نجات هستند، با تهدید مواجه میسازد؛ حق حیات از بنیادیترین و اساسیترین حقوق بشر است که در نظام بینالمللی حقوق بشر به رسمیت شناخته شده و حمایت از آن از اهمیت بنیادین برخوردار است؛ این حق صرفا به منع سلب خودسرانه حیات محدود نمیشود، بلکه مستلزم اتخاذ تدابیر لازم برای حمایت مؤثر از جان انسانها و جلوگیری از ایجاد شرایطی است که بهطور قابل پیشبینی، حیات افراد را در معرض خطر جدی قرار دهد؛ بر این اساس، حمله به شناورهای اختصاصیافته به عملیات جستوجو و نجات، با توجه به ماهیت بشردوستانه ماموریت آنان، پیامدهایی مستقیم برای بهرهمندی مؤثر افراد از حق حیات را به همراه دارد؛ زیرا تضعیف ظرفیتهای امدادی و نجاتبخش، امکان دسترسی افراد گرفتار در دریا به کمکهای فوری و ضروری را کاهش داده و خطر از دست رفتن جان آنان را افزایش میدهد.
اهمیت این موضوع از آن جهت دوچندان است که عملیات جستوجو و نجات دریایی، در شرایط اضطراری، مستقیما با حفظ جان انسانها ارتباط دارد؛ افرادی که در اثر حوادث دریایی، سوانح، شرایط نامساعد جوی یا سایر وضعیتهای اضطراری در معرض خطر قرار میگیرند، صرفنظر از تابعیت، ملیت یا هر ویژگی دیگری، نیازمند دسترسی سریع و مؤثر به خدمات امدادی هستند؛ هرگونه اقدام علیه ظرفیتهای جستوجو و نجات میتواند با ایجاد اختلال در این خدمات، خطر از دست رفتن جان افراد نیازمند کمک را افزایش دهد؛ از این منظر، آثار چنین اقدامی به کارکنان شناورهای هدف قرارگرفته محدود نمیشود، بلکه دامنهای گستردهتر از افراد غیرنظامی، دریانوردان و تمامی اشخاص گرفتار در وضعیتهای اضطراری در دریا را دربر میگیرد.
از منظر حقوق بشر، چنین اقدامی همچنین با تعهدات مربوط به حمایت از کرامت انسانی و تضمین برخورداری مؤثر افراد از حقوق بنیادین آنان در تعارض قرار دارد؛ انسانهایی که در شرایط اضطراری در دریا گرفتار میشوند، به دلیل وضعیت خاص خود در موقعیتی آسیبپذیر قرار دارند و دسترسی آنان به کمک و نجات، در بسیاری از موارد، شرط اساسی حفظ جان و سلامت آنان است؛ بنابراین، هرگونه تعرض به زیرساختها و تجهیزات امدادی که برای نجات این افراد اختصاص یافتهاند، میتواند موجب تشدید آسیبپذیری آنان و محروم شدن از امکان دریافت کمکهای ضروری شود.
افزون بر این، هدف قرار دادن شناورهای جستوجو و نجات، امنیت و سلامت جسمی و روانی نیروهای امدادی و نجات را نیز در معرض تهدید قرار میدهد؛ کارکنان این شناورها در اجرای وظایف حرفهای و بشردوستانه خود و با هدف نجات جان افراد و ارائه خدمات امدادی فعالیت میکنند؛ تعرض به آنان، نهتنها امنیت شخصی و حرفهای این نیروها را تهدید میکند، بلکه با ایجاد فضای ناامن برای انجام ماموریتهای امدادی، ظرفیت پاسخگویی به وضعیتهای اضطراری را نیز تضعیف میسازد؛ استمرار چنین وضعیتی میتواند آثار منفی گستردهای بر امکان ارائه خدمات امدادی و نجات مؤثر در دریا داشته باشد.
جمهوری اسلامی ایران، ضمن تاکید بر پایبندی خود به تعهدات بینالمللی و اصول بنیادین حقوق بشر و حقوق بینالملل بشردوستانه، اعلام میدارد که خدمات جستوجو و نجات دریایی را همچنان بهصورت مستمر، ایمن و بدون تبعیض در اختیار تمامی افراد گرفتار در دریا قرار خواهد داد؛ حفظ جان انسانها و حمایت از حق حیات، فارغ از تابعیت، ملیت یا هرگونه تمایز دیگر، از اصول اساسی فعالیتهای بشردوستانه جمهوری اسلامی ایران است و هیچ اقدام تجاوزکارانهای نمیتواند اراده این کشور را برای استمرار عملیات امدادی و نجات و ایفای مسئولیتهای انسانی و بینالمللی خود تضعیف کند.
در پایان، ستاد حقوق بشر جمهوری اسلامی ایران ضمن محکوم کردن شدید این جنایات و نقضهای آشکار حقوق بشر و حقوق بینالملل بشردوستانه، بر ضرورت تضمین امنیت نیروها، شناورها و تجهیزات امدادی و بشردوستانه تاکید میکند؛ از کمیسر عالی حقوق بشر سازمان ملل متحد و سایر نهادها و سازوکارهای ذیربط حقوق بشری سازمان ملل متحد انتظار میرود ضمن توجه جدی و فوری به این اقدامات جنایتکارانه، ابعاد و آثار حقوق بشری آن را مورد بررسی قرار داده و در چارچوب صلاحیتها و وظایف خود، اقدامات لازم را برای پیگیری این نقضهای آشکار، تضمین پاسخگویی عاملان و جلوگیری از تکرار چنین حملاتی به زیرساختها و تجهیزات بشردوستانه و امدادی به عمل آورند.

The Statement by the High Council for Human Rights of the Islamic Republic of Iran Condemning the Intentional Attacks by the United States on Maritime Search and Rescue Vessels
In the Name of God
The High Council for Human Rights of the Islamic Republic of Iran strongly condemns the deliberate attacks by the United States of America on the maritime search and rescue vessels of the Islamic Republic of Iran and related humanitarian equipment, and considers it a gross and blatant violation of the norms and rules of human rights, international humanitarian law, and the principles and regulations governing the International Law of the Sea. This crime is a continuation of a series of aggressive actions and gross violations of the obligations and rules of international law by the United States of America against the sovereignty, territorial integrity, and rights of the people of the Islamic Republic of Iran.
In the early hours of Thursday, July 23, 2026, the United States forces targeted two Islamic Republic of Iran maritime search and rescue vessels, named “Naji-15” and “Naji-16,” which were conducting humanitarian missions in the territorial waters of the Islamic Republic of Iran. Maritime search and rescue vessels, due to the purely humanitarian nature of their mission, have a special place within the framework of international humanitarian law. The exclusive mission of these vessels is to search for, rescue, and save the lives of people stranded at sea, and their activities are not related to military operations or direct participation in hostilities. Therefore, the intentional targeting of such vessels constitutes a serious violation of the fundamental rules of international humanitarian law and the principles governing the protection of relief and rescue operations.
Article 27 of the Second Geneva Convention of 1949 emphasizes the protection of boats and small vessels used by Governments or officially recognized coastal rescue organizations and provides that such vessels must be respected and afforded the necessary protection. At the time of the incident, the vessels “Naji-15” and “Naji-16” were operating solely within the framework of maritime search and rescue missions and were not involved in any military operations or direct participation in hostilities. Therefore, the intentional targeting of these vessels is a serious violation of international humanitarian law and a clear war crime.
It is clear that this criminal act by the United States not only directly endangers the lives of maritime search and rescue personnel and forces, but also threatens the safety of all persons in need of assistance and rescue at sea, regardless of their nationality, citizenship or identity. Attacks against equipment and facilities dedicated to search and rescue operations undermine the security and trust necessary for the conduct of humanitarian maritime missions and may have consequences extending beyond a specific incident for the safety of seafarers and persons in distress at sea. However, this incident cannot be considered a single incident. Since the beginning of the military aggression by the United States and the Zionist regime against the Islamic Republic of Iran, there have been numerous attacks on search and rescue vessels and sea ambulances of the Islamic Republic of Iran that had been operating in humanitarian and relief missions. The persistence of such crimes reflects a worrying pattern of attacks on humanitarian equipment and facilities that are protected under international law. Undoubtedly, supporting humanitarian and relief operations is a fundamental requirement of international humanitarian law, and no party can ignore these principles and put the lives of aid workers and civilians in need of assistance at risk. The targeting of humanitarian and relief assets, beyond its serious implications and consequences under international humanitarian law, gives rise to the international responsibility of the State responsible for the wrongful act and the individual criminal responsibility of those who perpetrate such acts.
However, the effects and consequences of these inhumane attacks are not limited to violations of international humanitarian law and regulations governing the safety and security of maritime activities, but also have serious effects and consequences from a human rights perspective. Targeting equipment and vessels whose exclusive mission is to search, rescue and save human lives at sea directly endangers the lives and security of rescue forces and, at the same time, threatens the ability to reach all those who need rescue services in emergencies at sea. The right to life is one of the most fundamental and essential human rights recognized under the international human rights system, and its protection is of paramount importance. This right is not limited merely to the prohibition of arbitrary deprivation of life; rather, it requires the adoption of necessary measures to ensure effective protection of human life and to prevent the creation of conditions that foreseeably place individuals’ lives at serious risk. Accordingly, attacks against vessels dedicated to search and rescue operations, given the humanitarian nature of their missions, have direct implications for the effective enjoyment of the right to life by individuals, as undermining rescue and relief capacities reduces the possibility of persons in distress at sea accessing immediate and essential assistance and increases the risk of loss of life.
The importance of this issue is further underscored by the fact that maritime search and rescue operations, in emergency situations, are directly linked to the preservation of human life. Persons who are exposed to danger as a result of maritime incidents, accidents, adverse weather conditions or other emergency situations, regardless of their nationality, citizenship or any other characteristic, require rapid and effective access to rescue and assistance services. Any action against search and rescue capacities may, by disrupting such services, increase the risk of loss of life for persons in need of assistance. From this perspective, the consequences of such an act are not limited to the personnel of the targeted vessels, but extend to a broader range of civilians, seafarers and all persons in distress at sea.
From a human rights perspective, such an act is also incompatible with the obligations relating to the protection of human dignity and the effective enjoyment of individuals’ fundamental rights. Persons who find themselves in distress at sea due to emergency situations are placed in a vulnerable position because of their particular circumstances, and their access to assistance and rescue is, in many cases, an essential condition for preserving their lives and health. Therefore, any attack on or interference with relief infrastructure and equipment dedicated to rescuing such persons may further aggravate their vulnerability and deprive them of the possibility of receiving essential assistance.
Furthermore, targeting search and rescue vessels also places the safety and physical and psychological well-being of rescue and relief personnel at risk. The crew members of these vessels perform their professional and humanitarian duties with the aim of saving lives and providing assistance services. Attacks against them not only threaten the personal and professional safety of such personnel, but also undermine the capacity to respond to emergency situations by creating an unsafe environment for the conduct of relief missions. The continuation of such a situation may have far-reaching negative effects on the ability to provide effective assistance and rescue services at sea.
The Islamic Republic of Iran, while emphasizing its adherence to international obligations and fundamental principles of human rights and international humanitarian law, declares that it will continue to provide maritime search and rescue services to all persons stranded at sea on a continuous, safe and non-discriminatory basis. Preserving human life and protecting the right to life, regardless of citizenship, nationality or any other distinction, are among the fundamental principles of the humanitarian activities of the Islamic Republic of Iran, and no act of aggression can weaken the will of this country to continue rescue and relief operations and fulfill its humanitarian and international responsibilities.
In conclusion, the High Council for Human Rights of the Islamic Republic of Iran, while strongly condemning these crimes and blatant violations of human rights and international humanitarian law, emphasizes the necessity of ensuring the security of relief and humanitarian forces, vessels, and equipment. The United Nations High Commissioner for Human Rights and other relevant United Nations human rights institutions and mechanisms are expected to pay serious and urgent attention to these criminal acts, examine their human rights dimensions and impacts, and, within the framework of their competences and duties, take the necessary measures to follow up on these blatant violations, ensure accountability of the perpetrators, and prevent the recurrence of such attacks on humanitarian and relief infrastructure and equipment.
